DISTANCE SALES AGREEMENT

BUYER: The individual who places an order via monsterpillove.com and agrees to this contract.

2. SUBJECT OF THE AGREEMENT

The subject of this Agreement is the sale and delivery of the products ordered by the Buyer from the Seller’s website monsterpillove.com. This agreement is governed by the Turkish Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

3. ORDER AND PAYMENT

  • Pricing: All prices are listed in USD and include applicable taxes unless stated otherwise.
  • Payment Method: Payments are processed securely via PayTR using Credit/Debit cards (Visa, Mastercard, American Express).
  • Currency Conversion: For international orders, the exchange rate applied by the Buyer’s bank during the transaction is the responsibility of the Buyer.

4. SHIPPING AND DELIVERY

  • Production Time: Since products are handmade, the processing and production time is typically 3 business days unless otherwise stated.
  • Shipping Carrier: Orders are shipped internationally via carriers such as [Shipentegra / DHL / FedEx / UPS / PTT].
  • Delivery Time: Estimated delivery times vary by destination (typically 3-7 business days for international shipping).
  • Tracking: A tracking number will be provided once the order is dispatched.

5. CUSTOMS, DUTIES, AND TAXES

The Buyer is the importer of record and must comply with all laws and regulations of the destination country. Orders shipped outside of Turkey may be subject to import taxes, customs duties, and fees levied by the destination country. All such additional charges are the sole responsibility of the Buyer. Monster Pillove has no control over these charges and cannot predict what they may be.

6. RIGHT OF WITHDRAWAL AND RETURNS

Under the applicable consumer laws, the Buyer has the right to withdraw from this contract within 14 days without giving any reason.

  • Exception (Personalized Goods): According to Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to goods prepared in accordance with the consumer’s wishes or clearly personal needs. This includes:
    • Monster Pillows with custom name embroidery.
    • Custom color or design requests.
  • Return Shipping: For eligible returns, the shipping cost and any associated customs fees are the responsibility of the Buyer.

7. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from this agreement shall be settled in the Consumer Courts and Arbitration Committees in Istanbul, Turkey.
